What made my day today was negotiating  a plea deal on a DUI over .15% BAC with a reckless driving charge thrown in.

I got my client 180 days deferred adjudication. Meaning that if he successfully completes the terms of probation in the next six months, the charges will be dismissed. This hasn’t happened since 1980 and Mothers Against Drunk Driving. I bought a lotto ticket tonight. I may turn water into wine. I think I can walk on water. It’s a Christmas miracle.

I got my client 180 days deferred adjudication. Meaning that if he successfully completes the terms of probation in the next six months, the charges will be dismissed. I sincerely hope this was his first offense and for your sake, that he successfully completes the terms of the probation. Most of all I hope he learned a very important lesson.

If this was not his first offense, then the judge is an idiot. Sorry if that sounds harsh, but I have no sympathy for anyone stupid enough to get behind the wheel of a car when their BAC is twice the legal limit.

It was first offense, but that still does not explain why the prosecutor was willing to do such a generous deal. I suspect it’s either because the arresting officer has left the force, or has some sort of disciplinary problem.

While I appreciate your feelings, I have a rather jaded view of the criminal justice system. The truth of the matter is there is no such thing. It is simply another form of taxation for the state to take money from people. A lot of innocent people are badly victimized, and a lot of horrible people get away with murder. That’s just the nature of the beast.

The state’s goal in most misdemeanor offenses is to make it so goddamn awful on the perp, that they never want to go through it again. And here I suspect they dropped the ball. But my role is that of an advocate, not a judge. And I did a damn good job.

Having been in the criminal justice system I congratulate you Toe on cutting a good deal for your client. On the other hand even when I was out stealing to support my drug habit, I and many other of my fellow addicts were against drunk driving. I know...both groups are under the influence of mood altering chemicals. I'm sure drunks at the bar felt the same about us.

As a repeat offender, I never should have gotten the deal my attorney was able to get for me. In fact the prosecutor would not agree to any plea bargain, just wanted to put me away. It was the judge who finally agreed to allow me to go to rehab instead of prison.  He pretty much said he was giving me enough rope to hang myself. Complete treatment and stay straight or sit behind bars.

I did see the light and became the so called productive member of society. Thirty six years later I still attend NA meetings and share my recovery with newcomers.

That's  because I had an attorney willing to fight for me. Attorneys are easy to hate or make jokes about... until you need one.

I’m definitely 50+ percent finished with the move. I’m getting up in the morning to drive back to Austin and pick up my son. And then I have three final days to get the rest of this hauled off, packed up, or thrown away. A lot of throwing away.  Will get it done. One room at a time.

UPDATE: I’m not a packrat, but every single space of this house is filled to the brim with old school work, photographs, finger paintings, art projects from summer camp… A bazillion Scout things. And all of them tug on your heart when you contemplate just throwing them in a trash bag. But the truth of the matter is, the kids don’t want this stuff. And I’m tired of curating a giant collection of junk that will never be a museum. My youngest called last night to say he would not be able to come help us with the move. And I told him “you’re just going to have to trust me then to sort your things. I promise you, I will throw 80% of it out.” But it is oddly liberating. I really feel like a weight is being taken off my shoulders. I’m going be at work next Monday owning roughly 20% of what I owned this Monday, and it’s great.

My wife and sons are pack rats. We still have clothes from when they were less then a year old, they’re 24. Our garage is packed full of all their old skate boards, bikes, aggressive skates and who knows what else. My life’s packed into a few bins in the attic and all my clothes.
We cleaned out their bedroom and closet over a few weekends. Donated around 12 garbage bags of clothes to Salvation Army. Threw a bunch of stuff into the dumpster across the street. Still can’t tell. And forget about the attic, that’s just getting worse. We cleaned out a bunch of stuff up there a few years ago. Filled a bunch of garbage cans, three trips with 2 cars each trip to my wife’s work to fill the dumpster and still packed.
I’ll get to reduce at some point, just don’t know when

I can see where that would feel liberating. I used to hang on to everything, telling myself it was for sentimental reasons. But I think much of it was just building an "emotional armor" around myself for various reasons, and old stuff helped add to that armor. These days, I'm more prone to throwing stuff away too quickly than holding on to it for too long lol

I just pulled 20 of my "been there" tshirts out. Daughter is taking them home to New York with her. Going to make me a "memory blanket" out of them. It was hard letting go but I get them back as a blanket. Pretty special!

I did see the light

I'm happy you did, and reading about it always makes me smile. I know/knew too many people who sadly never did see it. For example, my uncle was a hardcore alcoholic. I remember when I was little and in my teens, he always seemed to be in the hospital. It didn't help that my grandmother always made excuses for him and gave us bullshit reasons for the latest hospitalization. One time, he was supposedly walking down the street, was knocked unconscious from behind, and was driven several miles and then dumped in a field. Yet they didn't steal anything from him? I'm guessing he fell and hit his head at home.

Anyway, he was able to acknowledge eventually that he had problems, yet he always claimed that everything would be great if only he had his own house, was married, at his dream car, etc. To his credit, I guess he was a functioning alcoholic for a while, and was able to work hard enough to achieve all those things. That's when he then nosedived. I suppose he realized the house, wife, and car didn't magically make him any happier, and he lost all hope. Eventually, he managed to hit the brakes for a little bit, when he was diagnosed with prostate cancer and had it operated out. But then he went back to hardcore boozing, stopped looking after himself again, never went back to the doctor, and died eight years ago from inoperable lung cancer.

I know that's probably a bummer to read, but I wanted to provide some contrast for why reading about your seeing the light made my day  ;D

What the hell, one for you too, for being brave and letting them go.  ;D

No one will ever do that for me. I don't own a single shirt that pulls over my head, only button-up shirts, half long-sleeved for winter and the other half short-sleeved for summer.

Could almost put this in what ruined your day but
 decided here is better. Daughter and son-in-law along with the dog are heading back home as I type.

They were were here for two weeks and we got to spend a lot of time together. Even made a run to Wisconsin to stock up on cheese. :D Son-in-law came along. It's been awhile since I tried to make the drive so good to have a backup driver.

It's always hard to see them go. The good news is they plan to return in July. Normally we get two visits, spring and fall. A summer visit will add a third.

It's a big deal. The trip is 1500 miles with one over night stop. I made the trek once but after that it became more than we could handle.

It was a wonderful visit and already looking forward to the return.

My son borrowed a friend’s car and made a visit this week. It was a wonderful surprise. But he only lasted eight hours before he went back to the University.

I may not be a smart man Jenny, but I know how to get up early and rent a U-Haul, bag 40 bags of trash and take them to the dump, supervise the movers, call 1-800-GOT-JUNK to haul off all the outdoor detrius, load the U-Haul with all my precious goodies,  hire a carpet cleaner to power scrub three bedrooms, and get a gaggle of housekeepers to spit and polish every surface in the house. Take that landlord.

Heard excited kids voices outside our door. Figured correctly that it was the two neighbor kids. Went outside and both of them were bouncing up and down. They were chanting, "Puppy eve, puppy eve!"

Yes a new puppy will be arriving tomorrow afternoon. So, puppy eve.

It took me a while to stop laughing when they left. We're looking forward to seeing the new puppy, but it will be a long time before I'll forget the joy of PUPPY EVE! :emot_laughing:
