Well, good news for you fans of the middle finger. The U.S. Court of Appeals in Cincinnati ruled Wednesday that a motorist did not violate the law when she flipped the bird at a Taylor cop in June 2017 after a traffic stop. The court ruled she was exercising her free speech.

Well, that's a good precedent for Police Power, as well.  I got the shit kicked out of me by cops for using the "F" word, which is tantamount to the same thing.  They didn't arrest me, they didn't have anything to charge me with, but they sure searched me for it.

Yeah, sure.  The 4th Amendment too, but just because we are promised those rights, and privledges doesn't mean they can be excerized by everyone.  Unarmed black men can still be shot for less.

It also looks like there's a Double Jeopardy here too.  You can't write another ticket for the same violation, any more than you can re-try someone after they've been found not guilty, or sentenced.

Very informative... ty Julie!

Some people are like the 'slinky'. Not really good for much,
but they bring a smile to your face as they fall down stairs.

I gave a TSA agent a good profanity laced chewing out for fondling me.  Charges were filed in state dnd federal court, and I missed my flight.  Everything was eventually dismissed, after I pointed out to the judges that the Supreme Court has held repeatedly that a citizen can confront “state action” with protest.  Loud, even profane, protest.  I think the lead case is Arizona v. Houston.

In any event, it took hours of work away from me, and was a bit embarrassing.  The TSA sent 15 uniformed officers down to my arraignment, because “I [TSA] felt intimidated by his language.”  So yes, FUCK YOU.
