Incest according to the laws of most states involve sex between individuals and their progeny or siblings only. That is, personas and their children or grandcildren or between siblings. Do stories which include sex between aunts/uncle's and nephews/neices or between cousins require a disclaimer or have the "inc" code?

I'm not an author, but I read a lot of stories. (Have had a Literotica account for a while) I believe stories involving any one related by blood should still be considered incest. I've noticed some places require stories involving step-siblings (or a step parent) to be listed as incest (bullshit!) or pseudo-incest.

Actually it is not bullshit.

Sexual relations between family members who are not spouses, formally known as incest, is illegal across the U.S. because of the harm that it can cause to family relationships. States also recognize that children from incestuous relationships tend to struggle with genetic defects, which is another reason for prohibiting incest.

Laws typically prohibit sexual relations not only between blood relatives but also between certain people who are not blood relatives, such as adopted parents and children, stepparents and stepchildren, and foster parents and foster children. Close cousins are covered, but distant cousins may not be, unless they live in the same household like siblings. Meanwhile, some states outlaw marriages between close relatives, even if they do not involve sexual relations.

The part I said was bullshit is step-siblings. If they're not blood relatives, I don't think it should be listed as incest. Example: If two people are dating, and their divorced/widowed parents meet, fall in love, and get married, does that mean the two who were dating first should break up?

Sex with a stepparent is incest. There is no U.S. law that makes it illegal for * adult * stepsiblings to have sex or even become lawful husbands and wives. Even though they may be related through their parents' marriage, they are not related by blood, therefore, are not subject to consanguinity laws, which make it illegal for close blood relatives to get married. However if they are under the age of consent (16 to 18 years of age in the United States) it’s still considered statutory rape.

I believe sex between family members, whether related by blood or marriage, is incest. That said, for me, true incest is between blood relatives.

I’m sure any judge would take that as a valid defense. As long as it wasn’t “true” incest.

It depends on the law, therefore the country/state you live in, which also leads to the social convention where you live.

For instance, sexual relations between close blood relatives (parents and children/grandchildren, and siblings with each other) is illegal in most places. Some countries may not have specific laws, but it would still be socially unacceptable.

Step-parents, step-grandparents, step-siblings is an interesting one. While someone may say sex between a step-brother and step-sister is not real incest because they are not blood related, the brother and sister may have grown up in the same house/family, for instance, so there would definitely be a "yuck" factor there. More interestingly, due to the prevalence of this type of family situation compared to generations before, some western countries have introduced laws that include "steps" in incest laws that previously only applied to blood relatives. Also, in the past (especially before same-sex marriage), it was possible for one adult in a two adult cohabiting (sexual) relationship to adopt the other as their "child", for inheritance/financial/tax reasons. But any sex between them after this adoption could be breaking the incest laws in those countries where the law has changed. This is a whole area by itself, see https://en.wikipedia.org/wiki/Adult_adoption

Interesting also that in most countries it is not illegal to have sex with or marry your first cousin by blood. Negative reaction to this is very much more a social convention. In the British royal family (and many others) this was common - Queen Victoria and Prince Albert were first cousins. The late Queen Elizabeth II and Prince Philip were third cousins. The actress Greta Scacchi married her first cousin.

Aunts/uncles having sex with nieces/nephews I believe is the same as first cousins - not illegal in most places per se, as long as they are adults, but even more socially unacceptable than first cousin relations. You could maybe say these type of relationships have an incestuous feel, rather than the strict legal definition of incest - so I would include the "inc" story code in this case.

FWIW - I remember as a teen having crushes on first and second cousins and getting the feeling that they may have felt the same way. Nothing came of these crushes, but I think the incestuous feel on both sides made these crushes and subsequent fantasies even hotter.

Back to the original question: short answer - it depends.
